Terms of Service

These Terms of Service govern your access to and use of Dynamic QR Pro, including our website, account portal, QR code creation and management tools, redirect services, analytics, and related services, collectively, the “Service.”

By accessing the Service, creating an account, purchasing a subscription, or otherwise using Dynamic QR Pro, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Dynamic QR Pro provides hosted tools for creating, customizing, downloading, managing, and tracking dynamic QR codes.

The Service may allow you to create QR codes that resolve through infrastructure operated or managed by Dynamic QR Pro and redirect users to destinations you control or select. Depending on your subscription, features may include destination changes, QR customization, PNG and SVG downloads, scan analytics, and the ability to pause and reactivate QR codes.

Features, functionality, limits, and availability may change over time.

2. Eligibility and authority

You must be legally capable of entering into a binding agreement to use the Service.

If you use Dynamic QR Pro on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms. In that case, “you” includes that entity.

The Service is intended primarily for business and professional use.

3. Accounts

You are responsible for providing accurate account information and keeping it current.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity that occurs through your account.

You must notify us promptly at hello@dynamicqr.pro if you believe your account has been accessed or used without authorization.

We may require reasonable steps to verify account ownership before providing access, changing account information, or responding to certain requests.

4. Subscriptions, billing, and automatic renewal

Certain features require a paid subscription.

Prices, billing intervals, included features, and any applicable taxes are presented when you subscribe or purchase the Service. The price applicable to your account is the price presented to and accepted by you at the time of purchase, subject to any later pricing changes that apply to future renewal periods.

Subscriptions automatically renew for successive billing periods unless cancelled before the next renewal date.

By purchasing a subscription, you authorize Dynamic QR Pro and its payment processor to charge the payment method associated with your account for recurring subscription fees, applicable taxes, and other amounts you authorize.

Payment processing is currently provided by Stripe. Dynamic QR Pro does not store complete payment card numbers.

We may change subscription pricing or plan structure. Where required by applicable law, we will provide notice before a pricing change applies to a future renewal.

5. Cancellation and refunds

You may cancel your subscription through the available billing or account controls.

Unless otherwise stated when you purchase the Service, cancellation takes effect at the end of your current paid billing period. You may continue using paid features through that period.

Payments for subscription periods that have already begun are generally non-refundable and are not prorated, except where required by applicable law or where we determine otherwise in our discretion.

Cancellation stops future recurring charges. It does not automatically result in a refund for amounts already charged.

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection law.

6. QR codes, redirects, and account status

Dynamic QR codes created through the Service depend on Dynamic QR Pro infrastructure to process scans and redirect users to their configured destinations.

An active subscription may be required for QR redirects, analytics, destination management, and other paid functionality to remain active.

When a subscription ends, paid features and redirects may become inactive. We may retain account records, QR code records, identifiers, configurations, and related analytics for a period of time after a subscription ends to support account administration, restoration, security, legal obligations, or resubscription.

Retention of a record or identifier does not guarantee continued redirect operation, continued access, or indefinite preservation.

You are responsible for maintaining copies of QR code files and other materials you wish to retain.

7. Scan analytics

Dynamic QR Pro may provide analytics such as total scans, estimated unique scans, device categories, operating systems, timestamps, or similar information.

Analytics are provided for informational purposes and may contain estimates, inaccuracies, duplication, omissions, or differences from analytics generated by other platforms.

Estimated unique scans are not intended to identify or represent verified individual people.

We do not guarantee any particular level of accuracy, completeness, or availability for analytics.

8. Unlimited features and fair use

A subscription may describe certain features as unlimited, including QR code creation, destination changes, or scans.

Unlimited features remain subject to reasonable fair use and technical safeguards.

You may not use the Service in a manner that creates excessive or abnormal infrastructure load, materially affects service availability for other users, circumvents technical limits, generates artificial scan traffic, enables automated abuse, or is otherwise inconsistent with reasonable use of the Service.

We may investigate unusual activity and may limit, suspend, or restrict activity where reasonably necessary to protect the Service, its infrastructure, other users, or third parties.

9. Acceptable use

You may use Dynamic QR Pro only for lawful purposes.

You must not use the Service to facilitate or direct users to malware, phishing, fraud, scams, unlawful material, deceptive content, unauthorized collection of personal information, infringement of intellectual property or other rights, harassment, exploitation, or content or activity prohibited by applicable law.

You must not attempt to gain unauthorized access to the Service or another user's account, interfere with Service infrastructure, bypass security controls, reverse engineer the Service except where expressly permitted by law, scrape the Service in an abusive manner, or use automated systems to disrupt or materially burden the Service.

You are solely responsible for the destinations, websites, files, content, products, promotions, campaigns, and other materials connected to QR codes you create.

You are also responsible for complying with laws and regulations applicable to your business, advertising, products, destinations, and use of QR codes.

10. Your content

You retain ownership of content and information you submit to the Service, including QR names, destinations, branding elements, and other materials you provide.

You grant Dynamic QR Pro a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, modify as technically necessary, and otherwise use that content only as reasonably necessary to operate, secure, support, improve, and provide the Service.

You represent that you have the rights required to provide and use your content through the Service.

11. Dynamic QR Pro intellectual property

The Service, including its software, interface, design, branding, functionality, documentation, and other materials provided by Dynamic QR Pro, is owned by or licensed to Dynamic QR Pro and is protected by applicable intellectual property laws.

These Terms give you a limited right to use the Service. They do not transfer ownership of Dynamic QR Pro technology, intellectual property, trademarks, or other proprietary materials.

12. Communications

By creating an account or subscribing to the Service, you agree that we may send you communications reasonably necessary to operate and administer your account, including authentication messages, security alerts, billing information, subscription notices, service announcements, support responses, and material changes affecting the Service.

These operational communications are part of the Service and may continue while your account or subscription remains active.

Where permitted by applicable law, we may also send product information, feature announcements, tips, surveys, offers, promotions, and other commercial communications based on your consent, our existing relationship with you, or another lawful basis.

You may unsubscribe from promotional communications using the unsubscribe mechanism provided in those messages. Unsubscribing from promotional messages does not prevent us from sending operational or transactional communications necessary to provide or administer the Service.

13. Privacy

Our collection, use, processing, and disclosure of personal information is described in our Privacy Policy.

By using the Service, you acknowledge the practices described in that policy.

14. Third-party services and destinations

The Service relies on third-party providers for certain functionality, which may include payment processing, infrastructure, hosting, authentication, communications, security, and related services.

Your use of third-party services may also be subject to the third party's own terms and privacy practices.

Dynamic QR Pro is not responsible for websites, applications, products, content, privacy practices, availability, or services operated by third parties, including destinations selected by users for their QR codes.

15. Service changes and availability

We may modify, update, replace, limit, suspend, or discontinue features or portions of the Service where reasonably necessary for product development, security, legal compliance, infrastructure changes, abuse prevention, or business operations.

We may also change technical components used to operate QR redirects, analytics, URLs, domains, infrastructure, or related systems.

We aim to make the Service available reliably, but we do not guarantee uninterrupted or continuous availability.

The Service may be unavailable because of maintenance, outages, security events, third-party failures, internet conditions, technical problems, events outside our reasonable control, or other circumstances.

16. Suspension and termination

We may suspend or terminate access to all or part of the Service where we reasonably believe that you have violated these Terms, failed to pay amounts due, created a security or legal risk, engaged in fraudulent or abusive activity, subjected the Service to unusual technical load, initiated an improper payment dispute or chargeback, or used the Service in a way that may harm Dynamic QR Pro, its users, infrastructure, or third parties.

Where appropriate, we may disable individual QR codes or redirects without terminating the entire account.

We may take immediate action where necessary to address security, fraud, illegal activity, abuse, or significant risk.

You remain responsible for amounts properly incurred before suspension or termination.

17. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.

Dynamic QR Pro does not make warranties or representations that the Service will always be available, uninterrupted, secure, error-free, or suitable for every use, or that QR redirects, analytics, URLs, records, features, or third-party services will remain unchanged or continuously available.

You are responsible for determining whether the Service is appropriate for your intended use and for maintaining appropriate alternatives, backups, and business continuity plans for uses that are important to your operations.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

18. Limitation of liability

To the maximum extent permitted by applicable law, Dynamic QR Pro and its owners, affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunity, goodwill, data, content, or anticipated savings arising from or related to the Service.

To the maximum extent permitted by law, Dynamic QR Pro's total aggregate liability arising from or relating to the Service or these Terms will not exceed the amount you paid to Dynamic QR Pro for the Service during the twelve months immediately preceding the event giving rise to the claim.

These limitations apply regardless of the legal theory of liability and even if the possibility of damages was known or foreseeable.

Nothing in these Terms limits liability where doing so is prohibited by law.

19. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Dynamic QR Pro and its owners, affiliates, officers, employees, contractors, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your misuse of the Service, your QR code destinations or content, your violation of these Terms, your violation of applicable law, or your infringement of another person's rights.

20. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

Subject to any rights that cannot legally be waived, disputes arising from or relating to these Terms or the Service will be subject to the courts located in Ontario, Canada.

21. Changes to these Terms

We may update these Terms as the Service, our business, or applicable requirements change.

The updated Terms will be posted on this page with a revised “Last updated” date.

Where a change is material and applicable law requires additional notice, we may provide notice through the Service or by email.

Your continued use of the Service after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by law.

22. General terms

These Terms, together with the Privacy Policy and any subscription or purchase terms presented to you, form the agreement between you and Dynamic QR Pro concerning the Service.

If part of these Terms is found unenforceable, the remaining provisions will continue in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

You may not assign your rights under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the Service or our business.

We are not responsible for delay or failure caused by events beyond our reasonable control.

Provisions that by their nature should survive termination will survive, including provisions concerning ownership, payment obligations, disclaimers, liability, indemnification, and dispute provisions.
